Terms of Service

1. The service

Media Center (“the service”) is a set of apps for iPhone, iPad, Apple TV, macOS, Android, Android TV and Fire TV, operated by Web Bits (“we”, “us”), plus this website. The apps are an aggregator: they connect directly to the Plex or Jellyfin server a household already runs or already has lawful access to — one of each, or both — and bring what those servers hold behind a shared interface, per-person profiles, and a Kids mode.

We do not operate, curate, stock or maintain any media catalog of our own. Every title and stream a household sees comes from the source that household’s administrator configured. Video, audio and subtitles stream directly from that source to the device; they never pass through our systems.

2. Households, administrators and members

The service is organized around households. There is no public sign-up inside the apps. A household administrator registers on this site, connects one or more media sources, and invites members by email. An administrator is responsible for their household: who they invite, what a Kids profile is allowed to see, and which sources are connected.

You must be able to form a binding agreement to act as an administrator. A member joins at an administrator’s invitation and is bound by these terms for their own use of the service.

3. Your media sources are your responsibility

This is the core of how the service works, so we state it plainly: connecting a source to Media Center is not a grant of rights to that source’s content, and we grant none. By connecting a server or any other source, the administrator who connects it represents and warrants, on behalf of their household, that:

• they own the source, operate it themselves, or otherwise have a lawful right to access and to privately share it with the members of their household;
• connecting the source and streaming from it through the app does not infringe the copyright, trademark or other rights of any third party, and does not violate the terms of any service the source itself depends on; and
• everything the source makes available to their household is something they are entitled to receive and to make available to it — the service does not review, verify or endorse the legality of anything a household connects.

We do not select, index, host, cache or verify the content served by any source a household connects, and we have no visibility into a source’s content beyond what is needed to display it inside a household’s own apps. Responsibility for the lawfulness of a connected source rests entirely with the administrator who connected it.

4. Acceptable use

You agree not to use the service to:

• access, or help anyone else access, a media source that you do not have the lawful right to access;
• circumvent, disable or interfere with any rights-management, geographic-restriction or access-control mechanism of a connected source;
• resell, sublicense or provide access to a connected source, or to a Media Center account, to anyone outside your household;
• use the service in any way that violates applicable law, including copyright, broadcasting or telecommunications law in your jurisdiction; or
• probe, disrupt or attempt to gain unauthorized access to the service’s infrastructure or to another household’s account.

We may suspend or terminate an account or an entire household that we reasonably believe violates this section, with or without notice.

5. Copyright and rights complaints

We do not host media, but if you believe a household is using the service to access a source in a way that infringes your rights, tell us at privacy-mediacenter@webbits.dev with enough detail to identify the account and the material at issue. We will investigate and, where warranted, suspend or terminate the household’s access. Repeated or clear violations result in permanent termination.

6. Third-party services

The apps call other services directly from a household’s own devices: the household’s own media server; TMDB, OpenSubtitles and SubDL for artwork, descriptions and subtitles, each on the administrator’s own account with that service; and our own infrastructure on Amazon Web Services for accounts, profiles and viewing progress. Each third-party service is governed by its own terms, which the administrator is responsible for complying with when they supply credentials for it.

The apps are distributed by the App Store, Google Play and the Amazon Appstore. Those stores distribute the software and nothing else: they do not supply, license or endorse any media a household streams through it, and your agreement with each store is separate from this one. This agreement is between you and Web Bits alone; no store is a party to it or responsible under it.

7. No sale of content, no in-app purchases

We do not sell media, channels or subscriptions to any streaming service, and the apps contain no in-app purchase, subscription or paywall. Nothing in the service should be understood as us supplying, licensing or reselling any third-party catalog.

8. Disclaimer of warranties

The service is provided “as is”. We do not warrant that a connected source will be available, lawful in your jurisdiction, or free of errors, and we are not responsible for the content, availability or legality of any source a household connects.

9. Limitation of liability

To the fullest extent permitted by law, Web Bits is not liable for any claim arising from a household’s connection to, or use of, a media source that the household — not us — selected and configured, including any claim that such a source infringed a third party’s rights.

10. Changes to these terms

If we change these terms materially, we will update the date at the top of this page and, where the change affects how the service may be used, note it in the app’s release notes.

11. Governing law and contact

These terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law principles, and any dispute arising under them will be brought in the state or federal courts serving Union, New Jersey. Questions about these terms: privacy-mediacenter@webbits.dev.
